License Agreement

1. Introduction

This License Agreement ('Agreement') governs the use of all content, services, and resources provided by the eLearning Hooyia Platform ('Platform'), including but not limited to online courses, digital materials, interactive tools, quizzes, forums, and other educational resources. By accessing, browsing, or utilizing any content or services on the Platform, you, as a user (whether a student, instructor, or administrator), agree to be bound by the terms of this Agreement, which complements our Terms of Service and Privacy Policy.

This Agreement is designed to protect the rights of all parties involved, including eLearning Hooyia, its content creators, and users. It ensures that the Platform remains a secure, reliable, and high-quality environment for education. By agreeing to these terms, you acknowledge that you have read, understood, and accepted the responsibilities and obligations outlined herein. If you do not agree with any part of this Agreement, you must immediately cease using the Platform.

This Agreement applies globally to all users, regardless of their location, and is subject to applicable local, national, and international laws. eLearning Hooyia reserves the right to update this Agreement periodically to reflect changes in our services or legal requirements, with notifications provided via email or the Platform.

2. Grant of License

Upon successful enrollment in a course, subscription to a service, or registration as an instructor, eLearning Hooyia grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the course content and related services solely for personal, non-commercial, and educational purposes. This license allows students to engage with course materials, participate in interactive activities, and complete assessments, while instructors are permitted to use content for teaching and course facilitation purposes.

The license is valid only for the duration of your enrollment or subscription period and is subject to compliance with this Agreement, the Terms of Service, and any additional conditions specified during enrollment. Certain courses or features, such as premium content, certifications, or advanced tools, may require additional fees or subscriptions, as detailed on our Pricing page.

For example, a student enrolled in a programming course may access video lectures, coding exercises, and discussion forums, but may not share these materials with others or use them for commercial training purposes. Similarly, instructors may use provided templates or tools to enhance their teaching but are prohibited from redistributing these resources outside the Platform.

eLearning Hooyia reserves the right to revoke this license at any time for non-compliance, including but not limited to unauthorized sharing, misuse of content, or failure to adhere to payment obligations.

3. Course Content Types

The Platform provides a diverse range of educational content, categorized into two primary types: (a) Agent-Created Courses, which are developed by automated systems, artificial intelligence, or third-party content creators under eLearning Hooyia’s direction to ensure scalability, consistency, and accessibility; and (b) Instructor-Created Courses, which are designed and delivered by individual instructors to offer specialized, expert-led learning experiences tailored to specific subjects or skills.

Agent-Created Courses are typically structured to cover broad topics, such as introductory programming or language learning, and are optimized for large audiences with automated updates to maintain relevance. Instructor-Created Courses, on the other hand, may focus on niche areas, such as advanced data science techniques or creative writing, and reflect the unique expertise and teaching style of the instructor.

Both course types are subject to the same license terms outlined in this Agreement, though pricing, availability, and content creation processes may vary. For instance, Agent-Created Courses may be offered at a lower cost due to their automated nature, while Instructor-Created Courses may include premium pricing for their specialized content. All content is rigorously curated to meet eLearning Hooyia’s quality standards, with regular reviews and updates to ensure accuracy, relevance, and alignment with educational best practices. Users can expect a consistent and engaging learning experience across both course types.

4. Restrictions on Use

To maintain the integrity of the Platform and protect the rights of content creators, users are strictly prohibited from engaging in the following activities, which constitute a breach of this Agreement:

For example, downloading a course video and uploading it to a third-party website, sharing login details with a friend, or using course materials to create a competing educational product are all prohibited actions. Unauthorized use may result in immediate termination of your license and account, potential legal action, and liability for any damages caused to eLearning Hooyia, its instructors, or third-party licensors.

eLearning Hooyia employs monitoring tools to detect unauthorized use and reserves the right to investigate and take action against violators, including reporting to relevant authorities where applicable.

5. Instructor Content Ownership

Instructors retain full ownership of their original course content, including but not limited to video lectures, written materials, presentations, and other resources created by them. By uploading content to the Platform, instructors grant eLearning Hooyia a worldwide, non-exclusive, royalty-free, and sublicensable license to host, distribute, promote, translate, and adapt their content for Platform-related purposes, such as course delivery, marketing, and integration into other educational products.

For example, an instructor who creates a course on graphic design retains ownership of their lecture slides and videos but allows eLearning Hooyia to host and promote the course globally. Agent-created content, including courses developed by automated systems or third-party creators under eLearning Hooyia’s direction, remains the property of eLearning Hooyia or its licensors and is not subject to instructor ownership rights.

Instructors may request the removal of their content from the Platform, subject to the terms of our Instructor Agreement. Such requests must be submitted in writing to support@elearninghooyia.com and may be subject to a review process to ensure compliance with existing enrollments and contractual obligations.

eLearning Hooyia is committed to protecting instructor content and will take reasonable measures to prevent unauthorized use or distribution by third parties. Instructors are encouraged to report any suspected misuse of their content to our support team for investigation.

6. User-Generated Content

Users may contribute content to the Platform, including but not limited to reviews, comments, discussion forum posts, quiz responses, and other materials. By submitting such content, you grant eLearning Hooyia a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable license to use, reproduce, modify, adapt, translate, and display such content for Platform-related purposes, including improving user experience, enhancing course offerings, and promoting the Platform in marketing materials.

For example, a student’s review of a course may be featured on the Platform’s homepage, or a forum post may be used to improve course content. You are solely responsible for ensuring that your content complies with applicable laws, does not infringe upon third-party rights (e.g., copyrights, trademarks, or privacy rights), and adheres to our Community Guidelines, which prohibit offensive, defamatory, or inappropriate content.

eLearning Hooyia reserves the right to moderate, edit, or remove user-generated content that violates this Agreement, the Community Guidelines, or is otherwise deemed inappropriate. Users will be notified if their content is removed, and repeated violations may result in account suspension or termination.

By contributing content, you represent and warrant that you have the necessary rights to submit such content and that it does not violate any third-party rights or applicable laws.

7. Termination of License

Your license to access course content and Platform services will terminate under the following conditions: (a) completion of the course or subscription period, unless otherwise specified (e.g., lifetime access for certain courses); (b) violation of this Agreement, the Terms of Service, or any other Platform policies; or (c) termination of your account by you or eLearning Hooyia for reasons such as non-payment, fraudulent activity, or misuse of the Platform.

Upon termination, you must immediately cease all use of the content, including deleting any downloaded materials, such as PDFs, videos, or other resources, unless expressly permitted by eLearning Hooyia. For example, if your subscription expires, you may no longer access course videos or quizzes, even if previously downloaded.

eLearning Hooyia may also suspend or terminate access to content for operational reasons, such as Platform maintenance, legal compliance, or security concerns. In such cases, users will be notified where feasible, and alternative access options may be provided for enrolled courses. Refunds or extensions for terminated access due to Platform-initiated actions will be handled in accordance with our Refund Policy.

Users who violate this Agreement may face additional consequences, including loss of access to certifications, progress tracking, or other Platform features, and may be liable for damages caused by their actions.

8. Intellectual Property

All content on the Platform, including but not limited to agent-created courses, logos, trademarks, software, user interfaces, and other proprietary materials, is protected by copyright, trademark, patent, and other intellectual property laws. This includes the structure and design of courses, interactive tools, and branding elements unique to eLearning Hooyia.

Unauthorized use, reproduction, or distribution of protected content, such as copying course materials for public distribution or using the eLearning Hooyia logo without permission, may result in civil or criminal penalties. Users are encouraged to respect the intellectual property rights of eLearning Hooyia, its instructors, and third-party licensors to maintain a fair and lawful educational environment.

To report potential intellectual property infringement, such as unauthorized use of course materials or user-generated content that violates third-party rights, please contact us at support@elearninghooyia.com. Reports will be investigated promptly, and appropriate action will be taken, including removal of infringing content or termination of offending accounts.

eLearning Hooyia may also pursue legal remedies to protect its intellectual property, including seeking damages, injunctive relief, or other measures to prevent further unauthorized use.

9. Modifications to Content

eLearning Hooyia reserves the right to modify, update, or remove course content, services, or Platform features at its sole discretion to ensure quality, relevance, compliance with legal requirements, or alignment with educational goals. Modifications may include updating course materials to reflect new industry standards, removing outdated content, or adjusting features to improve user experience.

Significant changes that impact your access to enrolled courses, such as the removal of a course or changes to its core content, will be communicated via email or Platform notifications at least 14 days in advance, where feasible. For example, if a programming course is updated to include a new language version, enrolled users will be notified and provided access to the updated content.

Instructors may also propose updates to their content, subject to eLearning Hooyia’s approval to ensure consistency with Platform standards. Continued use of the Platform following content modifications constitutes acceptance of the updated content and terms.

Users are encouraged to provide feedback on content changes via our support channels to help us improve the Platform and address any concerns about accessibility or usability.
